Welcome to Notice of Record (www.noticeofrecord.org), a platform that allows users to create accounts, upload profile information, and manage public notices or records. By accessing or using our website and services, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with these Terms, please do not use our services.

  1. Acceptance of Terms

By registering for an account, uploading content, or otherwise using the Notice of Record website, you explicitly agree to these Terms and Conditions and our Privacy Policy, which is incorporated by reference. You must affirmatively accept these Terms during account creation or before uploading any content.

  1. Eligibility

  • The User Content does not violate any applicable laws, regulations, or third-party rights, including intellectual property, privacy, or publicity rights.
  • The User Content is not defamatory, obscene, offensive, or otherwise objectionable.

You grant Notice of Record a non-exclusive, worldwide, royalty-free license to host, display, and distribute your User Content solely for the purpose of providing our services. You may delete your User Content at any time through your account, and upon deletion, Notice of Record will remove such content from our systems, except as required by law or for backup purposes. We reserve the right to remove or disable access to any User Content that violates these Terms or is otherwise deemed inappropriate, at our sole discretion.

  1. Hold Harmless Agreement

You agree to hold Notice of Record, its affiliates, officers, directors, employees, and agents harmless from any claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising out of or related to the User Content you upload, including but not limited to claims of intellectual property infringement, defamation, or violation of privacy or publicity rights. You are solely responsible for the content you upload and any consequences arising from it.

  1. Prohibited Conduct

You agree not to:

  • Use the website for any unlawful or unauthorized purpose.
  • Upload or share content that is harmful, threatening, abusive, or discriminatory.
  • Attempt to gain unauthorized access to our systems or other users’ accounts.
  • Interfere with or disrupt the functionality of the website, including through the use of viruses, malware, or other harmful code.

Our total liability to you for any claim will not exceed the amount you paid, if any, to use our services.

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law principles. Any disputes arising under these Terms will be resolved through binding arbitration in Raleigh, in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.
